
We are members of the
MYBA and as such, work under their guidelines. Some years ago it became evident that all parties involved in chartering need to be protected legally - this is the aim of the MYBA Charter Agreement. The agreement is under constant revision and is modified every so often when it becomes obvious that the current agreement needs upgrading. It is always important for you to fully understand the contents of any contract that you sign, so if you have a hard time understanding any nautical terms, then your broker can help you out. Once you have made a decision on which yacht you would like to charter, booking is then secured as soon as possible, by completing a MYBA charter agreement. Upon signature and the subsequent counter-signature by the owner (or his representative) of the vessel, you will be required to confirm the booking by sending us a 50% deposit.
PLEASE NOTE: your booking is not confirmed until the deposit has been received. These funds are sent to a secure client account and are usually held in a type of escrow account by the stakeholder. The balance of the charter fee is due one month before embarkation, together with any VAT due or Advance Provisioning Allowance (APA) required. Payment should be made in US Dollars or €uros into our BCR client account by swift transfer. You will pay the bank charges for the transfer into our account and we will pay the charges for the despatch of the funds to the owner.
ADVANCE PREPARATION Once you have booked your holiday we will ask you to complete a preference sheet to itemise in detail your requirements for provisions for your charter, recreational interests, preferred itinerary, and any special requests. We will forward this on to your captain so that he and his crew members can prepare for your holiday. Most cooks are able to cater for any unusual dietary requirements. We will also put you in touch directly with your captain and crew before your charter so that you may discuss your ideas for itinerary and catering in more detail if you wish.
APA (ADVANCE PROVISIONING ALLOWANCE) 
If you are chartering in the Mediterranean or taking a motor yacht in the Caribbean, an Advance Provisioning Allowance (usually calculated at 25% of the charter fee) is required to cover the extra expenses of the charter not covered under MYBA terms. The APA allows the yacht to purchase prior to your embarkation the food, beverage and other requirements that you have specified in your preference sheets, and to pay for the fuel the yacht consumes on charter. It is generally calculated at around 25% of the charter fee, but may in some instances be higher (for example, on high speed yachts that consume a lot of fuel, or if your party has specified partucarly expensive wine or champagne). The captain will keep a detailed account of all costs and charges, with receipts, which you are welcome to inspect at any time. If necessary the captain will ask you for additional funds during your charter if your APA is exceeded, but this is rare. At the end of your charter, your captain will present his final accounts and receipts for your inspection and signature. Any outstanding funds will be refunded to you.
COMMUNICATIONS 
Most yachts are extensively equipped with sophisticated equipment for communication by voice, fax and sometimes data. The cost of your communications will be billed to you at the end of your charter. Please enquire if you have special requirements.
